Penalties of Causing a Death by Dangerous or Careless Driving

If convicted of death by dangerous driving or death by careless driving the respective penalties are as follows:-

  • Death by dangerous driving- A maximum prison sentence of 14 years and minimum period of disqualification of 2 years. In addition to this the driver must also pass an extended test of competency to drive before regaining a driving licence
  • Death by careless driving- A maximum prison sentence of 5 years and obligatory disqualification

Court proceedings for death by dangerous driving will always take place in the High Court of Justiciary whereas death by careless driving can be heard at Sheriff court level or the High Court.
