Early Removal of a Disqualification

The early removal of a disqualification from a driving licence is covered by Section 42 of the Road Traffic Offenders Act 1988. It provides that you may apply to the courts to have the period of disqualification removed from your driving licence early. The criteria as to when you are eligible to apply is as follows:-

• After 2 years if the disqualification imposed is less than 4 years.
• After 50% of disqualification period if it is less than 10 years but longer than 4 years.
• After 5 years if the disqualification period is longer than 10 years.

It is normally also a requirement that you have not been convicted of any criminal offence since the disqualification was imposed.

It is worth remembering that an application of this nature will normally go before the Sheriff whom imposed the disqualification period in the first place. Therefore, you are essentially asking a Sheriff to take the view that the sentence that he felt appropriate to impose in the first place should be cut short. Accordingly, if there is not good reason for you having your driving licence back and the application is not prepared and presented properly the Sheriff is unlikely to grant the early removal of the disqualification from your driving licence.
