The penalty for driving without insurance

August 2, 2019 News

As specialist road traffic lawyers based in Glasgow, we are accustomed to dealing with all types of road traffic offences in Sheriff and Justice of the Peace Courts all over Scotland.

From time to time we see a spike in prosecutions for particular offences which can often arise due to a variety of factors such as the introduction of speed cameras in a new area or targeted campaigns by the police for certain road traffic offences. At this point in time the road traffic offence which we are seeing prosecuted more regularly than any other is driving without insurance.

Driving without insurance is a road traffic offence that should not be taken lightly as the consequences upon conviction can be very serious but in our experience many drivers underestimate the potential consequences as they are not aware of the penalty for driving without insurance.

If you are charged for driving without insurance you can expect to receive between 6 and 8 penalty points or an outright disqualification from driving and a fine. These penalties for driving without insurance also apply if you are charged with permitting someone to drive your vehicle without insurance.

With the penalty for driving without insurance starting at six penalty points, one conviction for this road traffic offence can see you reach the halfway mark on the totting-up scale meaning that another conviction of this nature or a conviction for any other significant road traffic offence within 3 years could result in the loss of your driving licence.

The other concern with a no insurance charge is that with the range of penalty points being so restricted there is always an increased risk of receiving an outright disqualification.

In addition to all of this if you are guilty of driving without insurance you can expect some difficulties when arranging insurance cover in the future and at the very least expect much higher premiums.

However, a no insurance charge doesn’t always need to seem like the end of the world. With the best possible specialist legal advice and representation you can ensure that the damage to your driving licence is restricted and you may even avoid the penalties for driving without insurance completely if you have a special reasons argument.
